Public Perception of Bankruptcy
In recent years, chapter 11 proceedings have garnered increasing attention from the media and the public in general. With congressional hearings on mass-tort bankruptcies, Texas-Two Steps and venue reform, politicians have sought soundbites about bankruptcy law to drive media coverage. Additionally, high-profile events tied to bankruptcy filings, like the collapse of FTX and other cryptocurrency firms, have drawn the attention of many who otherwise ignore the goings on of bankruptcy courts. This panel will discuss these current public perceptions (and misperceptions) of bankruptcy proceedings and how they affect the day-to-day practices of lawyers and judges.

This panel will explore the growth of private credit as an established asset class, as well as trends in private credit restructurings. The panelists will explain the private credit market generally, key differences between direct lending and the broadly syndicated market, and the relationship between private credit and private equity. The panelists also will highlight private credit restructuring trends, including the factors that drive success for an out-of-court restructuring, and will spotlight some tools in the private credit restructuring toolbox.
Striking Gold: Unearthing Intangible Assets in Bankruptcy
Discover strategies for unlocking value in bankruptcy cases by identifying and preserving intangible assets. This session will focus on such key areas as social media assets, software, data and litigation claims. The panelists will share their insights on maximizing the value of these assets, including through pre-bankruptcy planning. They also will demonstrate how to use artificial intelligence (AI) to better understand these complex assets.

This panel will examine a host of real estate issues, including the intersection of reverse mortgages and bankruptcy, and the rights of heirs when a borrower files for bankruptcy; the distribution of equity in post-petition real estate sales, and how to determine who is entitled to the proceeds; whether, since Toth, the prime rate is the best measure of risk when applying the Till rate for total debt claims in bankruptcy; the classification of conduit payments, and whether direct mortgage payments should be considered part of bankruptcy plan payments; and effective strategies for addressing and resolving mortgage issues to guarantee that debtors achieve a fresh start post-bankruptcy.

Cancellation Policy
All fees, except a $75 handling fee, will be refunded if written notice of cancellation is received by July 3, 2024. No refunds will be granted after July 3, but substitutions will be allowed. After July 3, upon written request, a coupon for 20% off the registration fee (not including optional events) will be issued, which can be used (by the canceling registrant only) for any ABI educational program up to one year after this conference, or for this same conference next year.

9.5 hours of CLE credit, including 2.50 of ethics, are pending in states calculating CLE on a 60-minute hour, and 11.4 hours of CLE credit, including 3.0 hours of ethics, are pending in 50-minute-hour states. Credit hours granted are subject to each state’s CLE credit-approval regulations and might not be approved prior to the program. NY MCLE: This transitional and non-transitional program has been approved in accordance with the requirements of the CLEBoard for a maximum of 11.4 credit hours, of which 1.5 hours of credit can be applied toward the ethics professionalism requirement. California MCLE: ABI certifies that this activity has been approved for MCLE credit in the amount of 9.5, of which 2.5 hours will apply to ethics. 11.5 hours of CPE credit, including 3.0 hours of ethics, are also available.
